Legal Update – March 31, 2022

This week the United States Supreme Court held oral argument in the case of Ledure v. Union Pacific Railroad Company on appeal from the U.S. Seventh Circuit Court of Appeals.

Ledure focuses on whether the locomotive engine at issue was “in use” triggering the strict liability provisions of the Locomotive Inspection Act. These strict liability provisions enhance railroad safety and increase the chance of legal recovery for damages when railroaders are injured or killed in the line of duty while working on unsafe locomotives.
