Aviation (FTCA)
Although “fear of flying” is a common phobia in our country, especially amongst those who do not take to the air regularly, it is one of the safest means of transportation. Nevertheless accidents happen. Aviation accidents occur sporadically, but when they do they are usually catastrophic.
Aviation cases arise from a number of different circumstances. A commercial jet may go down for unknown reasons, later determined to be the result of pilot error or malfunctioning equipment.
A private aircraft may also crash due to weather or a mid-air collision with another small plane. Because only a fraction of attorneys practice in this area of law, these cases require experienced legal counsel with expertise to evaluate the case.
Our firm has successfully handled private plane crashes from Texas to Florida and commercial crashes in both Louisiana and Georgia.
In one aviation case, the firm brought suit against the Federal Government for errors committed by air traffic controllers. The case was tried in Orlando, Florida before a Federal Judge. The fatal accident occurred when the pilot of one plane ran into another aircraft in a mid-air collision. The Government was pursued for failing to have its nearby air traffic controllers warn the pilots that one plane was taking off while another plane was entering the airspace.
